The dispute dates to 2005, when owners of several condominium units sued SMU, saying the university fraudulently obtained controlling interest in the complex. In 2006, a federal judge ruled that the university had clear title to the land on which the University Gardens condominiums were built. SMU then tore down the condominiums, but a legal appeal has put the title issue back in court.
